What is a Declaratory Statement?

Declaratory Statement:

  • A Declaratory Statement is like a special request you can make to the Florida Board of Cosmetology. It's the only way to get an official interpretation or opinion from the Board about how certain rules and laws apply to a specific situation in cosmetology.

When to Use It:

  • You can only use a Declaratory Statement when you're not sure how the rules apply to your specific case. If you have questions about what you can or cannot do in your cosmetology practice, this is the tool to use.

How It Works:

  • If you have a question, you need to tell the Board all the details about your situation – like what you're doing, where you're working, and how everything is set up. If your question is something that affects everyone in cosmetology, the Board has to make a new rule about it. But, the Board can't decide the rules for the entire profession; only the Legislature can do that.

Petition for Declaratory Statement:

  • If you want the Board to consider your question, you have to file a "Petition for Declaratory Statement." This is like officially asking them to help you understand the rules. This request has to follow specific rules, and it gets publicly announced in a special publication.

Meeting and Decision:

  • If your request is accepted, you might be invited to a meeting to explain your question. Others who are interested can also join the meeting. The Board will make a decision and write up an official document explaining what they found and why they decided that way.

Limits of the Board:

  • The Board can only give opinions on rules mentioned in Chapters 477 and, when allowed, Chapter 455, Florida Statutes, and Rule Chapter 61G5, Florida Administrative Code. They can't decide about other laws or rules outside of their scope.

So, in simpler terms, it's like asking for a special opinion from the Cosmetology Board when you're not sure about the rules that apply to your specific situation. They'll listen, discuss, and then officially tell you what they think.
